This document is a translation from the Dutch version of October 6th, 2026. Dutch text remains the legally binding version.

Article 2: Placing properties

2.1

You may only place properties on Huurwoningen that you own yourself or for which you act on behalf of the owner;

2.2

The Advertisement must contain correct information about the property and give a realistic picture of it, in line with the requirements set by Huurwoningen. Huurwoningen reserves the right to change or remove advertisement texts that contain incorrect information;

2.3

The advertisement description must not contain any contact details;

2.4

Advertisements on Huurwoningen must not contain information about a third party (for example a letting agent, company logos, platforms, etc.);

2.5

Huurwoningen cannot be held liable for any infringement of copyright in the information in advertisements placed by or on behalf of landlords;

2.6

Advertisements that are no longer available, or for which a tenant has already been found, must be updated and/or removed from Huurwoningen by the User as soon as possible;

2.7

The User must make sure that every response received is dealt with properly;

2.8

Approaching private landlords about their Advertisements on Huurwoningen to win their business is not permitted. If Huurwoningen detects this, it may end the Subscription with immediate effect;

2.9

When a listed property is removed, Huurwoningen may keep the data shared when placing (and editing) the property. Huurwoningen uses this to monitor its statistics and the user experience on the site;

2.10

By placing the Advertisement, the User gives Huurwoningen permission to publish this data on Huurwoningen. Huurwoningen may also use the Advertisement for marketing and advertising purposes, with the aim of bringing the Advertisement to the attention of potentially interested home seekers or housing providers.

2.11

The User is responsible and liable for the content of the information they place on the Website. The User guarantees:

  • (I) that the content of the information they place does not breach the laws and regulations in force in the Netherlands and is not otherwise unlawful;
  • (II) that they do not use this information to treat other Users improperly or to harass them;
  • (III) that they will not harm the interests or the good name of the Website and will not place non-existent properties or property details;
  • (IV) that, when offering a property in an Advertisement, the property is actually available to let and they are entitled to offer it for rent.

The User also guarantees that they will not misuse the Website. Misuse includes placing:

  • discriminatory, indecent or offensive texts;
  • texts with sexual content or innuendo;
  • links to other Websites or Advertisements for other Websites;
  • Advertisements that do not fall within the purpose of Huurwoningen.
2.12

The User may only place Advertisements on the Website for properties located within the Netherlands. Properties located outside the Netherlands cannot be offered via the Website.

2.13

Huurwoningen shows rents per month. A property offered for rent must be available for a rental period of at least three (3) months.

Article 3: Combating illegal letting

3.1

To protect home seekers against illegal rental offers, landlords are not allowed to place advertisements with the following intent:

  • (I) Living there, but no registration. It is not allowed to offer accommodation where the occupant cannot or may not register at this address with the municipality. (This does not apply to short-stay properties.)
  • (II) Registration, but not living there. It is not allowed to offer a residential address that is not meant to be lived in, but where the tenant may register with the municipality.
3.2

These requirements follow from the Dutch Personal Records Database Act (Wet Basisregistratie Personen, BRP). If we find that an advertisement concerns an illegal offer of accommodation, Huurwoningen reserves the right to change or remove the advertisement text. In the case of such a breach, we always pass the advertisement and the landlord's contact details on to the competent ministry.

Article 4: Use of the Service and provision of information

4.1

It is not allowed to influence the Service negatively (or have it influenced negatively), or to use the Service or the data obtained from it to infringe the rights of others. This includes, among other things:

  • (I) sending (large-scale) unsolicited email or other communications;
  • (II) causing nuisance or disruption, for example by carrying out or coordinating denial-of-service attacks or running malicious software, such as viruses or spyware.
4.2

The personal data that the User receives from Huurwoningen may only be used to conclude a tenancy agreement for accommodation and for all related actions;

4.3

The User may not approach other Users for commercial purposes of any kind;

4.4

If Huurwoningen finds a breach of the above terms (or receives a complaint about one), it has the right to step in to end the breach. Huurwoningen also has the right to end the Agreement with immediate effect, without refunding any costs already paid. In addition, the User's account will be blocked;

4.5

If criminal offences are found, Huurwoningen may report them to the police. Huurwoningen is then entitled to give the User's name, address, IP address and other identifying data to a third party who complains that the User has breached their rights or these General Terms and Conditions, provided that the complaint is sufficiently plausible, there is no other way to obtain this data, and the third party has a clear interest in receiving it and is (legally) authorised to receive it.

4.6

Huurwoningen may recover from the User any damage it suffers as a result of the User breaching the clauses above.

Article 5: Messaging Service

5.1

Huurwoningen may offer a Messaging Service for communication between Users and Home Seekers, through which messages are sent, received and displayed via the Huurwoningen infrastructure. By using the Website and the account, the User agrees that communication with Home Seekers may take place fully or partly via the Messaging Service.

5.2

As part of the Messaging Service, Huurwoningen processes metadata (such as the time, number, direction and response times of messages). Where the law and the privacy statement allow this, Huurwoningen may also process the content of messages automatically, for purposes including:

  • a. offering Home Seekers a central overview of their conversations;
  • b. safeguarding the integrity and security of the Website, including fraud prevention;
  • c. improving and optimising the Huurwoningen service;
  • d. assigning quality indicators to the User's profile, as set out in more detail in Article 6.
5.3

The processing of messages via the Messaging Service is fully automated. Huurwoningen staff do not have regular access to the content of messages. More information about the processing of personal data, the purposes, the legal bases and the retention periods is set out in the Huurwoningen privacy statement.

5.4

The User is responsible for using the Messaging Service carefully, lawfully and professionally, and will not use it for purposes that breach the law, these terms or the Terms of Use, including in any case Article 10 of the Terms of Use (Misuse of the Website).

5.5

Huurwoningen makes reasonable efforts to ensure that the Messaging Service works reliably, but does not guarantee that it will be available without interruption or errors. Article 11 of the Terms of Use (Liability) applies accordingly.

Article 6: Display and use of data

6.1

Huurwoningen may show or otherwise make available information about the User, their organisation, services, activities or performance, insofar as this is based on the use of the Website and the Huurwoningen Service or on data processed in it, on platforms, websites or services operated by Huurwoningen (or its affiliated companies). This may be done in, among other things, profiles, search results, comparisons, rankings, quality indicators (such as badges) or other displays of information for third parties, including Home Seekers and other Users.

6.2

The information referred to in 6.1 may be based on, among other things, metadata from the Messaging Service (as described in Article 5), data from Advertisements, behavioural data within the account and information supplied by the User. Huurwoningen decides on the content, form and display of this information at its own discretion.

6.3

Huurwoningen is responsible for setting the criteria for, and assigning, quality indicators (such as badges) based on the data referred to in 6.2. Indicators are assigned automatically and are in principle binding on the User. If the User believes that an indicator is based on incorrect or incomplete processing, the User may submit a complaint to Huurwoningen using the contact details on the Website.

6.4

Article 7 applies to the ranking of Advertisements in the search results. Data referred to in 6.2 is only used for this insofar as it is mentioned in Article 7. For other rankings as referred to in 6.1, Huurwoningen complies with the Platform-to-Business Regulation (Regulation (EU) 2019/1150).

Article 7: Ranking of Advertisements

7.1

By default, Users see Advertisements in the 'Recommended' order. Huurwoningen decides this order. If a User chooses a different order, such as newest first, rent, floor area or price per m², the chosen order applies.

7.2

Huurwoningen only shows Advertisements for available properties in the search results. Advertisements with another status, such as under offer or let, are not shown in the search results.

7.3

For the 'Recommended' order, Huurwoningen uses the following main parameters, in order of importance:

  • (I) Expected interest: when an Advertisement is placed or changed, Huurwoningen automatically calculates the chance that a User who views the Advertisement will respond to it. This is done with a statistical model trained on Huurwoningen's historical data and based only on the Advertisement features listed in 7.4. The higher the expected interest, the higher the Advertisement ranks;
  • (II) Time of placing: the expected interest is combined with how long the Advertisement has been online. New Advertisements get a higher position on the first day, and to a lesser extent in the first week. From two weeks after placing, this weight gradually decreases.
7.4

The expected interest referred to in 7.3 under (I) is based on the following features of the Advertisement, in order of importance:

  • a. the rent: the amount itself, the rent compared with the usual rent in the same town or city, and the rent per m². Advertisements with a rent above the usual level in that town or city will generally rank lower;
  • b. the location of the property;
  • c. the size and layout of the property: the floor area and the number of rooms and bedrooms;
  • d. the type of property, such as flat, house, room or studio, and the kind of property, such as mid-terrace house or deck-access flat;
  • e. to a limited extent: the year of construction, the floor, the number of photos, the number of bathrooms and whether the property is suitable for students.
7.5

The more complete the property details in the Advertisement, the better Huurwoningen can calculate the expected interest.

7.6

The Provider cannot influence the ranking by making a payment or giving any other fee to Huurwoningen. The product or subscription the User buys also has no effect on it.

7.7

The 'Recommended' order is the same for every User and is not personalised.

7.8

Huurwoningen does not publish the exact calculation, to prevent misuse and manipulation of the search results.

7.9

Huurwoningen may change the calculation. If the main parameters in 7.3, the features in 7.4 or their order of importance change, Huurwoningen will amend this article in line with Article 16.3 of the Terms of Use.
